TERMS OF SERVICE

PRICES:

1. Shipping from Switzerland at the net price, customs and import tax will be charged in the respective recipient country.
2. The shipping costs are calculated when ordering before payment, depending on the number, size and weight of the products.

GENERAL:

1. The following general terms and conditions apply to all contracts, deliveries and other services. Differing rules of the contractor, we hereby expressly oppose. All ancillary agreements require our written confirmation.

2. Arion Schuler is entitled at any time to change or supplement these General Terms and Conditions, including any attachments, with a reasonable notice period. Orders received before then will be processed according to the old General Terms and Conditions that are still valid.

DEALS:

1. Our offers are non-binding. Small deviations and technical changes compared to our illustrations or descriptions are possible.

PAYMENT AND DELIVERY:

1. Our invoices are payable within 10 days without deduction. Other payment agreements are only valid if we confirm them in writing.

2. We reserve the right to make a partial delivery if this appears advantageous for speedy processing. Special forms of shipment requested by our customers will be charged with a customary local surcharge.

DELIVERY TIMES:

1. Goods that are in stock (we are not liable for transport problems) will be dispatched within 2-3 days. If the goods are not in stock when the order is placed, we will endeavor to deliver as quickly as possible. If non-compliance with a delivery or service deadline is due to force majeure, labor disputes, unforeseeable obstacles or other circumstances for which we are not responsible, the deadline will be extended appropriately. If the delivery deadline is not met for reasons other than those mentioned above, the buyer is entitled to set a reasonable grace period in writing with the threat of refusal and, after this has expired without success, to withdraw from the contract with regard to the delivery or service contained in the contract. If the impossibility of delivery is based on the inability of the manufacturer or our supplier, both we and the buyer can withdraw from the contract if the agreed delivery date is exceeded by more than 2 months. Claims for damages due to delay or impossibility or non-performance, including those that arose before the contract was withdrawn, are excluded. PASSING OF RISK:

1. The risk passes to the buyer when Arion Schuler dispatches the goods. This is customary in the trade and means that claims for damage against the carrier (Post, UPS, DPD, etc.) can only be made by the recipient.

WARRANTY:

1. Arion Schuler guarantees that the goods sold are free of material and manufacturing defects at the time of the transfer of risk and have the contractually guaranteed properties.

2. We cannot assume any liability for color deviations in printed SafeCards. We pass on your print data with color information (HKS or Pantone) to the printer with all due care and ask you to do so before placing the order, the OK to print.

3. Upon arrival, the customer must examine the goods immediately for defects and condition. In the event of obvious defects, these must be reported to us in writing within 3 days of discovery, as must hidden defects. Otherwise the warranty for these defects is void. In the case of complaints, the date of purchase must be proven with an invoice. The item complained about must be sent in with sufficient postage together with a copy of the invoice. We only accept returns if they have been agreed in advance.

4. The warranty does not cover normal wear and tear. The warranty expires if the customer changes the delivered goods.

5. During the warranty period, the customer has the right to free repairs. A partial or complete exchange of the article is permissible.

6. If defects are not remedied within a reasonable period of time, the buyer is entitled to conversion or reduction.

RESERVATION OF TITLE:

1. The goods remain the property of Arion Schuler until full payment has been made.

RIGHT OF WITHDRAWAL:

1. You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods or in the case of a contract for several goods that you ordered as part of a single order and which are delivered separately, on the day on which you or a third party named by you who is not the carrier took possession of the last goods.

2. Consequences of the revocation:
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. 3. Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts

for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
for the delivery of goods that can spoil quickly or whose expiry date would be exceeded quickly,
for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
for the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature,
for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and the current value of which depends on fluctuations on the market over which the entrepreneur has no influence,
for the delivery of sound or video recordings or computer software in a sealed package if the seal has been broken after delivery
for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.
